Proposed Laws

Kitselas is in the process of reviewing two new laws: a Property Taxation and a Property Assessment Act.  These two pieces of legislation have been brought forward to Kitselas Chief & Council for their first reading.  Chief & Council have approved the first reading and have triggered a public review process.  This notice begins the public review process which is in effect from December 10th 2011 to February 10th 2012.  The public has the opportunity to review the law and make presentations to the Law Review Committee.

NOTICE OF PROPOSED LOCAL REVENUE LAWS
AND
INVITATION TO MAKE REPRESENTATIONS

 

NOTICE IS GIVEN, pursuant to section 6 of the First Nations Fiscal and Statistical Management Act (hereafter referred to as the “FSMA”), that the Kitselas Band Council proposes to enact the Kitselas Property Assessment Act, 2012 and the Kitselas Property Taxation Act, 2012 (hereafter referred to as the “Proposed Laws”).

DESCRIPTION OF PROPOSED LAWS:  The Proposed Laws are a property taxation law and a property assessment law, both made under the authority of section 5(1)(a)(i) of the FSMA.  The property assessment law provides for the assessment and valuation of interests in land on the reserve lands of Kitselas, including appointing assessors, inspecting property, preparing assessment rolls, and mailing assessment notices.  The property assessment law provides a process for reconsideration of assessments and for a right of appeal to an independent assessment review board.  The property taxation law establishes a taxation regime that taxes interests in land in the reserve, and includes provisions for exemptions, grants, preparing tax rolls and tax notices, the levy of penalties and interest on unpaid taxes, and the collection and enforcement of unpaid taxes.

THE KITSELAS BAND COUNCIL INVITES WRITTEN REPRESENTATIONS regarding the Proposed Laws.  Written representations may be made to the Council from the date of this notice until February 10, 2012. 

Persons wishing to make a written representation must deliver the document containing the representations to:

Representations should be made on or before 4:00 pm, February 10, 2012 in order to ensure consideration by Council. 

Before making the Proposed Laws after February 10, 2012, Council will consider all written representations received in accordance with this Notice.
